App Store &
Device Terms

This agreement is between you and Antive Ltd only. The app store from which you obtained the app (the “App Store Provider”) is not a party to it. Antive Ltd, not the App Store Provider, is solely responsible for the Aulax app and its content.

You are granted a non-transferable licence to use the Aulax app on a device that you own or control, and as permitted by the usage rules of the App Store Provider.

Antive Ltd, not the App Store Provider, is responsible for addressing any claims from you or any third party relating to the app or your possession and use of it, including but not limited to:

• product liability claims;
• any claim that the app fails to conform to any applicable legal or regulatory requirement;
• claims arising under consumer protection or similar legislation;
• intellectual property infringement claims.

Antive Ltd, not the App Store Provider, is responsible for providing any maintenance and support for the app. The App Store Provider has no obligation to furnish maintenance or support.

You must comply with the applicable terms of the App Store Provider through which you obtained the app when using it.

You represent and warrant that:

• you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist-supporting” country; and
• you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with all applicable export control and sanctions laws and regulations.

You must comply with applicable third-party terms of agreement when using the app — for example, your wireless data service agreement.

Where you obtain the app from the Apple App Store, the following apply in addition to the terms above:

8.1 These terms are between you and Antive Ltd only, and not with Apple Inc. (“Apple”). Your licence to use the app is governed by Apple’s standard Licensed Application End User License Agreement, as supplemented by these terms and the Aulax Terms of Use.

8.2 In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and all other claims are the responsibility of Antive Ltd.

8.3 You and Antive Ltd acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these terms, and that, upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.

Where you obtain the app from Google Play, the following apply in addition to the terms above:

9.1 These terms are between you and Antive Ltd only, and not with Google LLC (“Google”). The agreement governing your use of the app is solely between you and Antive Ltd; Google is not responsible for, and has no liability under, these terms.

9.2 Your use of the app through Google Play is also subject to the Google Play Terms of Service, which you agree to comply with.
